ATC LIGHTING — TERMS OF SERVICE & CUSTOMER AGREEMENT
Last Updated: September 2026
By approving an estimate, submitting payment, storing a payment method, or receiving services from ATC Lighting ("Company"), the client ("Client") legally enters into this Master Agreement.
PART 1: GENERAL BILLING, CARD-ON-FILE & PAYMENT TERMS
1.1 Stored Payment Credentials & Automatic Billing Authorization
Automatic Charge Authorization: The Client authorizes ATC Lighting to securely store credit card, debit card, or ACH payment credentials on file via our payment processor (Jobber Payments).
Payment Schedule:
Seasonal Services: The remaining 75% balance is charged automatically to the card on file upon completion of the installation.
Permanent Installations: The remaining 50% balance is charged automatically upon completion and system testing.
Recurring & Renewal Services: For recurring seasonal clients, seasonal retainers will be billed automatically in accordance with confirmed pre-season renewal notifications.
Chargebacks & Disputes: By providing payment details and accepting these terms, the Client waives the right to dispute charges with their card issuer for work completed or non-refundable retainers forfeited under the terms of this Agreement.
Late Payments & Collections: Accounts unpaid after five (5) business days incur a $50 late administrative fee and accrue interest at 1.5% per month (or the maximum rate permitted by law). The Client agrees to pay all collection agency fees, court costs, and reasonable attorney fees incurred while pursuing past-due balances.
PART 2: SEASONAL HOLIDAY LIGHTING (FULL-SERVICE LEASE)
2.1 Seasonal Lease & Equipment Title
Rental Nature of Service: Seasonal lighting packages operate strictly on an all-inclusive rental basis. All commercial-grade C9/C7 LEDs, wiring, splitters, jumpers, ground stakes, clips, timers, wreaths, and garlands remain the exclusive personal property of ATC Lighting.
No Client Alterations: The Client shall not attach additional personal lights, move cords, tamper with timers, or adjust roofline hardware. Unauthorized alterations void our maintenance warranty and incur service fees.
2.2 Retainer & Cancellation
25% Retainer: A non-refundable 25% retainer is required to reserve an installation slot. Work is booked first-come, first-served.
Cancellations: Retainers are refundable only if written notice is received at least 48 hours prior to the scheduled installation appointment. Cancellations made inside 48 hours forfeit the retainer.
2.3 Season Maintenance Guarantee & Takedown
Maintenance SLA: We provide complimentary service calls within 24 to 48 hours (weather permitting) for bulb outages, detached clips, or timer resets through December 31st.
Exclusions to Free Service: Outages caused by severe natural disasters, fallen tree limbs, vandalism, pets, or wildlife (e.g., squirrels chewing wires) are not covered and are billed at our standard $75 dispatch fee plus materials.
Takedown & Storage: Removals begin January 2nd and continue through late January as winter weather safely permits. All equipment is inventoried, packed, and stored by ATC Lighting. Client presence is not required.
PART 3: PERMANENT ARCHITECTURAL LIGHTING (SALES & SYSTEM INSTALLATION)
3.1 Ownership & Custom Orders
Transfer of Ownership: Permanent aluminum channel tracks, LED pucks/nodes, data controllers, and dedicated power supply boxes are purchased by the Client. Title transfers upon full payment of the project balance.
50% Custom Fabrication Retainer: A 50% non-refundable deposit is required prior to purchasing, cutting, or custom powder-coating materials.
3.2 Mechanical Fastening & Trim Conditions
The Client authorizes ATC Lighting to mechanically fasten track channels directly to fascia, soffit, or trim using exterior-grade screws. ATC Lighting is not liable for existing rot, degraded wood, sagging fascia, or loose trim boards.
3.3 Limited Workmanship & Hardware Warranty
Workmanship (1 Year): ATC Lighting warranties all physical mounting labor and wiring connections for twelve (12) months from install date.
Hardware: Components carry the manufacturer’s product warranty (typically 3–5 years). After Year 1, labor to diagnose, service, or replace high-elevation components is billed at standard hourly service rates.
3.4 Smart Features & Network Disclaimers
Systems require an active, stable 2.4 GHz home Wi-Fi network at the controller location. ATC Lighting is not liable for third-party mobile app updates, home internet outages, router replacements, or forgotten passwords. Wi-Fi reconnection visits are billed as standard service calls.
PART 4: ELECTRICAL INFRASTRUCTURE, SAFETY & PROPERTY LIABILITY
4.1 Electrical Infrastructure & Licensed Electrician Requirement
Standard Power Access: The Client must supply functional, dedicated exterior 120V GFCI electrical outlets within 25 feet of primary lighting tie-ins.
Licensed Electrician Requirement: ATC Lighting is a low-voltage lighting and decorating contractor, not a licensed electrical contractor. If existing circuits are overloaded, non-functioning, or lack adequate capacity—or if permanent installations require dedicated breakers, new conduit runs, panel upgrades, or new exterior receptacles—all such electrical modifications must be completed by a licensed and insured electrician hired directly by the Client at their sole expense.
Tripped Breakers Disclaimer: ATC Lighting is not responsible for pre-existing household wiring deficiencies, breaker trips caused by unrelated indoor appliances, or nuisance trips caused by moisture in aging GFCI outlets.
4.2 Property Access, Pets & Safety
Access: The Client grants ATC Lighting unobstructed exterior access during daylight hours. Driveways and work paths must remain clear of parked vehicles, equipment, and ice/snow.
Pets: All domestic animals must be secured safely indoors during service visits. ATC Lighting is not liable for pets escaping through open gates.
Trip Hazards: While ATC Lighting secures extension cords cleanly, the Client acknowledges that temporary cords and ground stakes present inherent trip hazards and agrees to exercise reasonable caution.
4.3 Weather Contingency
Roof access and exterior work will not take place during rain, freezing rain, snow, ice accumulation, or high winds. Weather postponements are rescheduled within 24 hours and do not warrant deposit refunds.
4.4 Insurance & Damage Reporting
ATC Lighting maintains active Commercial General Liability insurance. Any alleged property damage must be documented and submitted to ATC Lighting in writing within forty-eight (48) hours of service completion; otherwise, claims are waived.
